YES – do not trust anyone to see the truth or to find what is necessary to clear your name. The investigators and decision makers are Trauma Informed trained. This means they start with the idea that no one falsely accuses a person of sexual assault, that all discrepancies of the victim actually support that s/he was sexually assaulted and telling the truth, and that if you are not stopped you will do it again. There is no presumption of innocence – you must prove yourself innocent. The burden of proof is “by a preponderance” which means who do I believe more. The rules are often biased against you. People lie. Your witnesses may be more concerned with their own possibly bad behavior (drugs, underage drinking) than telling the truth. The school is not required to talk to anyone that does not come to their office. If you do not present perfectly at the interview, they will use all discrepancies against you, all inferences against you, all misunderstandings against you, all minimization against you, and more.
